Data centers in a Colombian Free Trade Zone: potential advantages and mandatory questions
The regime may favor certain operations, investments, and goods; contracting capacity inside a Free Trade Zone does not automatically transfer every benefit to the customer.
01 · The regime
A delimited area with special rules
Colombia’s Ministry of Commerce defines Free Trade Zones as delimited areas where industrial, service, or commercial activities operate under special tax, customs, and foreign-trade rules. The current regime is based on Decree 2147 of 2016 and later amendments.
Official information lists treatments for qualified users and goods introduced into the zone. That does not mean every company buying colocation receives the same rate or exemption.
02 · The advantages
Equipment, ecosystem, and operations may improve the equation
For an operator or user meeting the conditions, customs treatment of imported equipment while it remains inside the zone may affect investment and renewal. For the customer, provider concentration, connectivity, energy, physical security, and expansion capacity may also matter.
Those advantages must be demonstrated with data-center evidence and contractual terms. Free Trade Zone location does not replace due diligence on availability, carriers, sustainability, recovery, support, and accountability.
03 · The decision
Validate who receives which benefit
Before requesting a quote, clarify whether the provider is a qualified user, which goods and services are covered, how local or foreign customers are invoiced, and what happens when equipment leaves for the national customs territory. The answer requires tax, customs, and contractual validation for the specific case.
